Terms and Conditions

Thank you for choosing to learn German or Czech with me in 1-on-1 lesson or in the Mentoring program. By purchasing an online lesson or mentoring program from me, you give your consent with Terms & Conditions. Make sure you know what you are committing to and what your and my obligations are.

  1. Introduction

1.1 These Terms & Conditions (hereinafter “Terms”) apply to services provided by the Seller, Daniela Grunwald, concluded with the Buyer through remote communication means via the Seller’s website www.linguadoo.com, email, or phone contact between the Buyer and the Seller.

1.2 These Terms define the rights and obligations of buyers (customers) and the Seller, who is a self-employed individual. In matters not regulated by the purchase agreement and these Terms, this relationship is governed by the Civil Code and consumer protection laws. The Terms are an integral part of the purchase agreement.

1.3 These Terms are published on the Seller’s website and apply to the sale of products and services on www.linguadoo.com.

1.4 The Seller is authorized to sell goods based on registration by DIAN, Colombia.

  1. Order

2.1 The product name, description, and price are stated on the respective service pages. The price is also specified on the invoice. The offer remains valid while displayed on the web interface.

2.2 Language service orders include information about the customer, the ordered service, price, and payment method. Payments are accepted through bank transfer in EUR or CZK unless mutually agreed otherwise.

2.3 The contractual relationship between the Seller and the customer is established by placing an order for language services (not after confirming the order). From this moment, mutual rights and obligations arise, defined by the purchase agreement and these Terms. By placing an order, the customer acknowledges having read and agreed to these Terms. The valid order condition requires providing billing details (customer’s address and the number of agreed lessons) to the Seller.

2.4 Information about the technical steps leading to the conclusion of the contract is evident in the ordering process, and the customer has the opportunity to review and correct the contract before submitting it. The details in the order are considered correct by the Seller.

2.5 The customer agrees to the use of remote communication means when concluding the contract.

2.6 The contract is concluded in the Spanish/German/English/Czech language. The contract or relevant tax document will be stored in the Seller’s electronic archive for five years from its conclusion, accessible only to the parties involved.

2.7 The Seller is obliged to provide the service that the customer ordered, and the customer undertakes to accept the service and pay the purchase price.

  1. Price, Invoice

3.1 The price of products, goods, and services is stated on the website www.linguadoo.com in their respective pages. The prices are listed in EUR. The price is always specified on the invoice, including the number of purchased lessons or products. The Mentoring for Self-Learners is invoiced according to the price list on the www.linguadoo.com website.

3.2 Invoice: The Seller issues an invoice regarding payments made based on the contract, which is sent to the customer’s email inbox. The invoice serves as proof of the purchased product or service after payment. The Seller is not a VAT payer. The price on the invoice is always indicated in COP and in EUR or CZK.

3.3. The Seller accepts payments in CZK (Czech Koruna), in EUR (Euro) and alternatively in COP (Colombian Peso) or USD (American dollar).

  1. Payment Method

4.1 Payment can be made by bank transfer in CZK to Daniela Grunwald’s account 1019470947/5500 or in EUR to account IBAN: DE23500502011241790041. Payments in COP to my Colombian account or USD via online transferring services are possible too. Any additional costs related to transfers are covered by the buyer. Please notify me in advance, before issuing the invoice, about the currency in which you want to pay.

4.2 Payment Form: Only single payment is possible; instalment payments are not accepted. The payment must be made before the start of the cooperation.

4.3 The purchase price is due by the invoice date, no later than 14 days from the invoice date. The customer’s obligation to pay the price for the product/service is fulfilled when the corresponding amount is credited to the Seller’s account.

  1. Delivery Method

5.1 Teams/Skype/Meets lessons will be provided on a mutually agreed-upon date. The schedule of regular lessons will be determined together during the introductory lesson. If we do not agree on the schedule, both the buyer and the seller have the right to terminate the contract.

5.2 The e-lesson within the Mentoring program will be delivered on Thursday and corrected on Wednesday. Classes are taught via Google Classroom platform.

5.3 Purchased lessons are non-refundable and valid for 6 months.

  1. Contract termination

6.1 Withdrawal from the contract by the consumer

If the buyer is an end consumer, he/she has the right to withdraw from the contract within 14 days of receipt/delivery of the service, without giving any reason and without any penalty. This right does not serve as a means of settling a complaint.

6.2 If the buyer decides to withdraw within this period, he must comply with the conditions set out below:

No later than on the 14th day after receipt of the service, a letter of intent to withdraw must be sent to the seller. In this case, please contact me at grunwald.daniela@gmail.com together with the tax receipt (invoice) for payment.

The money for the product/service will be refunded in the same way as received and within 14 days of withdrawal. The Seller is not obliged to return the funds received to the Customer until the Customer has handed over the goods to the Seller or has proved that he has sent the goods to the Seller and acknowledged receipt of the correcting tax invoice.

In the case of a customer’s withdrawal from the contract for an online educational product, the Seller is entitled to deactivate and disable access to the product immediately upon receipt of the customer’s withdrawal.

6.3 Withdrawal from the contract by the seller

The Seller is entitled to withdraw from the Purchase Contract without unnecessary delay if it finds that the other party has violated the Contract in a material way. For the purposes of this contract, a material violation of this contract shall be defined as:

-Delay in payment of the purchase price by the customer more than 7 days after the due date

-copying and distribution of paid content to third parties

  1. Cancellation, rescheduling and no-show policy

7.1 The Buyer may be absent from German/Czech language lessons during the pre-paid period, but must notify the Seller at least 24 hours before the next scheduled lesson by e-mail to grunwald.daniela@gmail.com. If the buyer fails to do so, the price for the missed lesson will be charged in the full amount.

7.2 In the case that the buyer apologies more than 24 hours before the lesson, buyer and seller will mutually agree new alternative date and time. The lesson will be conducted on the new agreed-upon date.

7.3 If the buyer fails to attend the lesson within 20 minutes of the agreed start time of the German/Czech lesson without informing the seller in advance (via phone or email), the lesson is automatically cancelled and is considered to have been attended without the possibility of a replacement.

7.4 In the case of serious illness or unexpected occasions, individual arrangements can be made – interruption of the course, alternative dates, etc.

7.5 Purchased lessons are non-transferable and non-refundable and are valid for the following 6 months. If the student cannot complete the purchased lessons, it is possible to exchange the individual lessons for the e-lessons package. For courses with a predetermined duration (12 weeks) there is no possibility of interruption.

7.6 In the case of Mentoring program, lessons cannot be interrupted or rescheduled during the course. Each pre-paid Mentoring section lasts 12 weeks, and the content of each e-lesson can be adapted to the current state of the student – illness, vacation, workload – such as less or more tasks, easier or more complex topic. The buyer will receive 1 e-lesson per week for the entire paid period in their Google Classroom. If the buyer (student) does not submit the completed assignments or submits them late, the seller (tutor) is not obliged to correct them.

In case the student fails to complete the e-lesson 4 times in a row, stops interacting in Google Classroom and does not actively participate in the mentoring, the cooperation on the part of the tutor will be terminated, without the possibility of financial or other compensation.

7.7 The buyer has the right to contact the seller with a request for correction (via email to grunwald.daniela@gmail.com) if he/she is not satisfied with the way the seller has handled his complaint or if he/she believes that the seller has violated his rights. If the seller rejects this request or fails to respond within 60 days of sending it, the buyer has the right to propose an alternative dispute resolution with the entity. The buyer-consumer has the right to an out-of-court settlement of a consumer dispute.

  1. Disclaimer

8.1 All products and services offered by the Seller are for educational purposes in the field of German/Czech language and online learning, online business, language or pedagogical self-development and are only guidelines and recommendations. The Seller is not in any way responsible for the success or failure of the Buyer in applying them in practice. The buyer is fully self-responsible and fully accountable for his/her actions, behaviour and decisions. The success of the buyer depends on a number of other factors beyond the seller’s control, such as the buyer’s skills, capabilities, knowledge, abilities, health, the decisions the buyer makes, the market situation.

8.2 The lifetime guarantees of access to the online product lasts for the duration of the specific product website.

8.3 The Seller is not responsible for any damage caused by the use of the Seller’s products or services.

8.4 The Seller is not responsible for any damage caused by force majeure or other circumstances beyond their control.

8.5 The Seller reserves the right to refuse to provide services to anyone for any reason.

8.6 Any disputes arising from the contractual relationship between the Seller and the customer will be resolved primarily through negotiation. If an amicable agreement cannot be reached, the dispute will be submitted to the relevant court in Colombia.

8.7. Seller reserves the right to modify these Terms at his discretion. Changes and clarifications will take effect immediately upon their posting on the website.
